These Terms and Conditions govern your use of our websites and your purchase of products distributed by AfterMark LLC through aftermark.net, coldrider.com, and fuelpumper.com ("we", "us", or "our").
By placing an order or accessing our sites, you confirm that you have read, understood, and agree to be bound by these terms. If you are purchasing on behalf of a business, you represent that you have authority to bind that business.
01 — Overview
What these terms cover
These Terms and Conditions apply to all transactions, accounts, and interactions with AfterMark LLC and its distribution brands — ColdRider and FuelPumper. They cover the purchase of aftermarket automotive and industrial parts and supplies through our wholesale and retail distribution channels.
These terms do not supersede any separate written distributor agreement you may have executed with us. In the event of a conflict, the signed agreement takes precedence.
Our Privacy Policy is incorporated into these terms by reference and governs how we handle your personal information.
02 — Eligibility & accounts
Who can purchase from us
Our wholesale distribution channels are open to licensed businesses, resellers, fleet operators, and repair facilities. Retail purchases through our consumer-facing storefronts are open to any individual 18 years of age or older.
Account registration
Wholesale accounts require an approved application including a valid resale certificate or business license. We reserve the right to approve or deny any account application at our discretion. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Account suspension
We may suspend or terminate accounts that violate these terms, fail to meet payment obligations, or engage in fraudulent activity. You will be notified by email before suspension unless immediate action is required to protect our systems or other customers.
03 — Orders & purchasing
How orders work
All orders are subject to product availability and acceptance by AfterMark LLC. Submission of an order constitutes an offer to purchase; acceptance occurs when we confirm the order in writing or ship the goods, whichever comes first.

We reserve the right to cancel or limit quantities on any order, including after confirmation, if stock levels change or if we identify pricing errors. In such cases, a full refund will be issued promptly.
04 — Pricing & payment
What you'll pay and when
All prices are listed in US dollars and are subject to change without notice. The price in effect at the time your order is confirmed is the price you will be charged. Quoted prices do not include applicable taxes, freight charges, or fees unless explicitly stated.
Payment terms
Approved wholesale accounts may be offered Net 30 payment terms. All other orders require payment in full at the time of purchase. We accept major credit cards, ACH bank transfers, and wire transfers. A 3% processing fee applies to credit card payments on invoices over $2,500.
Past-due accounts
Invoices not paid within terms are subject to a late fee of 1.5% per month (18% annually) on the outstanding balance. We reserve the right to place accounts on credit hold and require prepayment on future orders until the balance is resolved.
Taxes
You are responsible for all applicable sales, use, and excise taxes. Wholesale customers with a valid resale certificate on file will not be charged sales tax on qualifying purchases. It is your responsibility to keep your certificate current with us.
05 — Shipping & delivery
Getting your order to you
We ship from our distribution center via UPS, FedEx, LTL freight carriers, and USPS depending on order size and destination. UPS is our primary carrier. Risk of loss and title pass to you upon delivery to the carrier at our facility (FOB Origin), unless otherwise agreed in writing.
Freight damage
Inspect all shipments upon receipt before signing the carrier's delivery receipt. If damage is visible, note it on the delivery receipt and refuse the shipment, or accept it with a written exception. Hidden damage must be reported to us within 5 business days of delivery. Failure to follow these procedures may affect your ability to file a claim.
Delivery estimates
Shipping timelines are estimates only and are not guaranteed. We are not liable for delays caused by carriers, weather, customs, or other circumstances beyond our control. Expedited shipping upgrades are available at checkout for time-sensitive orders.
06 — Returns & claims
Our return and credit policy
We stand behind the products we distribute. Returns and credits are handled as follows:
Stock returns
Unused, resalable stock may be returned within 30 days with prior authorization. A 15% restocking fee applies.
Defective product
Defective items are replaced or credited in full. Contact us within 60 days of receipt with part number and description of the defect.
Incorrect shipment
If we ship the wrong item, we will arrange return freight at our expense and ship the correct item at no charge.
Non-returnable items
Electrical parts, special-order items, and items sold as-is or on clearance are non-returnable unless defective.
All returns require a Return Merchandise Authorization (RMA) number issued by our customer service team. Returns sent without an RMA will be refused and returned to sender at the sender's expense.
07 — Warranty
Product warranty coverage
Products sold by AfterMark LLC carry the manufacturer's warranty as provided. We pass through all available manufacturer warranties but do not independently warrant products beyond what the manufacturer provides.

Warranties are void if products are improperly installed, modified, used outside their rated specifications, or subjected to accident, abuse, or neglect. Labor costs associated with warranty repairs are not covered unless expressly stated in writing.
Disclaimer. Except as expressly stated above, all products are provided "as is" without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by law.
08 — Limitation of liability
The limits of our responsibility
To the fullest extent permitted by applicable law, AfterMark LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, loss of data, vehicle damage, or downtime — arising out of or related to your use of our products or services, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising under these terms shall not exceed the amount you actually paid to us for the specific product or service giving rise to the claim in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
09 — Intellectual property
Ownership of content and marks
All content on our websites — including text, images, product photography, logos, trademarks, and catalog data — is owned by or licensed to AfterMark LLC and is protected by applicable intellectual property laws.
Approved wholesale partners may use our product images and descriptions solely to market and sell our products in their own channels, provided they do not alter, remove, or obscure any branding or copyright notices. Any other use requires our prior written consent.
You may not use our trademarks — AfterMark, ColdRider, FuelPumper — or any confusingly similar marks without our express written permission.
10 — Governing law
Disputes and jurisdiction
These Terms and Conditions are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising under or related to these terms shall be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
Dispute resolution. Before initiating formal legal proceedings, both parties agree to attempt in good faith to resolve any dispute through direct negotiation. If unresolved within 30 days, either party may pursue available legal remedies.
Class action waiver. You agree that any claims will be brought solely in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
11 — Changes to terms
When things change, we'll tell you
We may update these Terms and Conditions from time to time to reflect changes in our business, legal requirements, or industry practices. When we do, we will revise the "last updated" date at the top of this page.
For material changes affecting existing wholesale accounts, we will provide at least 30 days' advance notice by email. Your continued use of our websites or placement of orders after the effective date constitutes acceptance of the revised terms.
